Cuban Ministry of Justice confirms update to notarial procedures



HAVANA, Cuba, February 10 (ACN) The Ministry of Justice of the Republic of Cuba (Minjus) confirmed via its Telegram channel that the new Notary Law came into effect on January 7, 2026.

This law introduces modifications to personal and family procedures, simplifying processes and strengthening transparency.

Among the affected acts are marriage, civil unions, wills, and declarations of heirs, with substantial changes to their authorization protocols. According to the regulations, instrumental witnesses are eliminated in marriages and wills, leaving the notary as solely responsible for verifying identities, legal capacity, and the free expression of will.

A five-business-day prior publicity period is also established for marriages, civil unions, and declarations of heirs, with the publication of full names and the type of procedure on official channels, with the prior consent of the interested parties.

The information disclosed is limited to the essentials, with the aim of safeguarding the legitimate rights of third parties, who may file a reasoned objection with the notary within the established timeframe.

The Ministry of Justice recommends that citizens consult in advance with the notary of their choice to learn about the new requirements and necessary documentation, and to consider the publication period when planning the legal transaction.
