Former Cuban minister Alejandro Gil Fernández sentenced for multiple crimes



The Supreme People’s Court (TSP) issued a statement on Monday, informing about the notification of sentences to Alejandro Miguel Gil Fernández, which, due to its importance, we are transmitting in its entirety:

The Supreme People’s Court reports that on Monday, December 8, 2025, it notified the sentences in the criminal proceedings against the defendant Alejandro Miguel Gil Fernández.

The oral hearings took place between November 11 and 13, 2025, and between November 26 and 29.

In the first criminal case, he was found guilty of the crimes of espionage and acts detrimental to economic activity or contracting; as well as bribery, theft and damage of documents or other objects in official custody, and violation of official seals and infringement of regulations protecting classified documents, the latter being continuous offenses.

As a result of this classification, the Court imposed a combined sentence of life imprisonment.

In the second trial, he was found responsible for the crimes of continuous bribery as a means to an end in order to commit falsification of public documents; as well as influence peddling and tax evasion, both continuous offenses.

In this case, the Court imposed a combined sentence of twenty years’ imprisonment.

In both trials against Gil Fernández, accessory penalties were applied, including confiscation of assets, prohibition from holding positions involving the administration or control of human, material, and financial resources, and deprivation of public rights, among others.

To determine the sanctions to be imposed, the Court took into account Article 147 of the Constitution of the Republic, as well as Articles 71.1 and 29 of the Penal Code, related to the purposes of the sanction, evaluating the social harm of the acts committed by the accused.

Alejandro Miguel Gil Fernández, through corrupt and deceitful actions, took advantage of the powers granted by the responsibilities he assumed to obtain personal benefits, receiving money from foreign companies and bribing other public officials to legalize the acquisition of assets. He deceived the country’s leadership and the people he represented, thereby causing damage to the economy. He failed to follow work procedures with the classified official information he handled, stole it, damaged it, and ultimately made it available to the enemy.

These highly damaging actions demonstrated in the accused an ethical, moral, and political degradation that warrants a severe criminal response, as demanded by Article 4 of the Constitution of the Republic, which establishes that treason against the Homeland is the most serious of crimes and that whoever commits it is subject to the most severe penalties. The sanctioned acts also violate the United Nations Convention against Corruption, of which Cuba is a signatory member.

The accused and the Public Prosecutor’s Office have the right to file the appeals established by law within a period of ten days.

Regarding the sentence of life imprisonment, even if the sentence is not challenged, the Court will ex officio process an appeal, as a guarantee for the accused enshrined in the Law of Criminal Procedure.

Once the appeals against the sentences have been resolved, if the accused’s guilt is upheld, a single, combined sentence will be imposed, to be served from all the penalties imposed, as provided for in Article 86 of the current Penal Code.

Both the accused and his lawyers acknowledged that during the processing of the cases and the oral trial acts, the rights and guarantees enshrined in the Constitution of the Republic and the Law of criminal procedure were fulfilled.
