Cuban deputies evaluate implementation of the Procedural Law



HAVANA, Cuba, Dec 18 (ACN) Regardless of the modifications made, the Procedural Law allows to face crime in the country and guarantee the greatest severity in correspondence with the most serious crimes, said Yamila Peña Ojeda, attorney general of the Republic, today in Havana.

Appearing at the meeting of the Standing Committee on Constitutional and Legal Affairs that precedes the 2nd Ordinary Session of the National Assembly of People's Power (ANPP) in its 10th Legislature, Peña Ojeda emphasized the scope of the regulations to expand the responsibility and protagonism of the body in the judicial activity on the island.

She explained that these legal provisions have had an impact on a more rigorous examination of the fulfillment of rights and principles of due process by the prosecutors, who have the power to exercise judicial control in the processes and to be present in the different stages of the investigations.

These actions also extend to the differentiated treatment of victims, guarantees of the rights of detainees and professional preparation to deepen the knowledge of the law by prosecutors to raise and standardize compliance and quality of due process, she added.


On this issue, Ruben Remigio Ferro, president of the People's Supreme Court (TSP by its Spanish acronym), explained that it has required structural and functional adaptations of the courts to be at the level of what the Law implies.

He emphasized that this reality forces the different levels of the institution to work better and insist on the training of the operators of the law in the satisfactory delivery of justice.

Remigio Ferro pointed out that this will has resulted in the strengthening of the links between the judicial bodies and the specialized chambers of the TSP, which allow the consolidation of spaces for the collegiality of matters and exchanges of experts to achieve more accurate and uniform responses of legality in the different cases that require it.

In this way, authorities of the General Directorate of Criminal Investigation of the Ministry of the Interior ( MININT) attended to update on the application of procedural laws in the fight against crime.

This results in the studies and analysis of the legal body in the collectives strengthened by the elaboration of complementary regulations in the models of action for the investigative activity, adjusted to the new laws, such as the imposition of precautionary measures of the Provisional Prison, the Prohibition of leaving the country to the accused and the procedure before the crime of Disobedience.

The session was attended by Oscar Silvera Martinez, Minister of Justice, Jose Luis Toledo Santander, President of the Permanent Commission of Constitutional and Legal Affairs of the ANPP, and other representatives of the institutions related to the issue.
